TERMS AND CONDITIONS
1. SELLER[1.1] Beauty Boulevard Ltd. is a company registered in England and Wales with company number 8764421 at 6 Dallas Court, Salford, Manchester, M50 2GF, United Kingdom. VAT registration number 199225274.
2. ORDER PROCESS[2.1] Products are subject to availability. If we are unable to supply the products, we will inform you of this as soon as possible. A full refund will be given if you have already paid for the products.
[2.2] If you enter a correct e-mail address we will send you an order confirmation e-mail and order update e-mail(s).
[2.3] Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and Beauty Boulevard Ltd. will take place at the point the products you have ordered are dispatched from our warehouse to be delivered to the address you have given us. It does not take place until that stage, even though we may have debited your card or we have sent acknowledging e-mails (see 2.2 above). Very occasionally an error may occur resulting in the products described on our website not being the products actually available for sale. If this occurs your order will not be or have been accepted. We may ask you whether you wish to purchase other products we may have available or the products which may have been dispatched to you in error. If so your order will be amended. Otherwise, we will treat any order as cancelled and any incorrect products dispatched will be collected for full refund.
[2.4] All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions.
[2.5] We do not file details of your order for you to access so please print out these terms and conditions and the order confirmation for your own record.
3. PAYMENT[3.1] Payment may be made by the methods indicated in our payment options, shown at the bottom of every page. If paying by gift card, where your gift card balance is more than the amount of your order, we will deduct the total from your gift card, and leave any remaining balance on the gift card. If the gift card balance is less than the amount of your order, we will ask you to pay the remaining order balance using another payment option.
[3.2] You will be charged the current price for buying products from our website at the date you place your order. All prices are displayed on our website and are inclusive of VAT (where applicable). We reserve the right to amend prices if there is a change in the rate of VAT. All total prices for goods and services at the checkout represent the total price payable by the customer for those items, regardless of the address for delivery. For delivery to the EU, this price includes VAT (or VAT equivalent) at the current rate. Although this price is the same for deliveries outside the EU, where VAT (or VAT equivalent) may not be applicable, customers are not entitled to any discount or refund to account for the differences in tax treatment and will pay the same price for the item as a customer placing an order for delivery to the EU. Other components of the total price at the checkout, including delivery charge, may vary for each customer.
[3.3] A delivery charge will be applied at checkout, based on the total weight of your order and delivery location.
[3.4] We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the products at the correct price. If we are unable to contact you, we will treat the order as cancelled. We will not accept an order if there is a pricing error.
4. DELIVERY[4.1] We deliver to any UK address including most British Forces Post Offices. We also offer international delivery to a number of countries. All orders for international deliveries are subject to our terms and conditions.
[4.2] Orders may require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advice that a delivery has been attempted. and that the product(s) have either been left with a neighbour or returned to your local delivery office.
[4.3] Orders must be placed by 3pm for same day dispatch Mon-Thurs, and by 1pm on Friday. Any orders placed after this time will be dispatched next working day. Working day means all days from Monday to Friday, excluding bank holidays.
[4.4] Next Day deliveries will not arrive until the second working day if placed after 3pm. Please be aware that unless Next Day Delivery with Saturday Guarantee is selected, any Next Day orders placed after 3pm on a Thursday will not be delivered until the following Monday or next working day.
[4.5] It is your responsibility to ensure the delivery address is ready and able to accept delivery of the product.
[4.6] For any orders delivered to freight forwarding companies, Hotels, B&Bs, storage and relocation companies nominated by you as accepting delivery on your behalf, we shall have no liability to you in respect of any product which is damaged following acceptance of the delivery by these locations on your behalf. These goods are at your risk on and after delivery to these locations and/or carriers.
[4.7] Delivery times are estimates only and Beauty Boulevard Ltd. shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather, strikes or transport problems.
5. CANCELLATION & RETURNS[5.1] If, for any reason, you wish to cancel your order you may do so as long as it has not already been processed and shipped. You can either e-mail or telephone our Customer Services Team via our contact us page to arrange this.
[5.2] It is important that you check your delivery upon receipt and always before use. If any errors occur or issues arise then these need to be reported to us immediately so we can investigate. Should your delivery arrive damaged or an incorrect item is sent, we will do our best to rectify the situation. We cannot refund cosmetic products for any other reason due to hygiene reasons.
[5.3] For instructions on how to return an order, please contact our team via our contact us page. We will need to know your order number, the item you want to return and the reason for return. Upon receipt of these details a member of our Customer Services Team will be in touch.
[5.4] We will review each case individually when considering the return of the products; in some cases we may require further information such as pictures so we can choose the best course of action. Our aim is to provide the best solution for you as quickly as possible.
[5.5] Refunds will be made using the same means of payment as you used for the initial transaction. Refunds can take up to 10 working days to clear from the date of agreement.
[5.6] You will need to obtain a proof of postage receipt when you send a return to us. Proof of postage does not cost anything but without it we may not be able to process your refund or replacement in the rare event that your delivery is lost in transit. Any item you return is your responsibility until it reaches our warehouse. Please therefore ensure that you send your item back to us using a delivery service that insures you for the value of the goods.
[5.7] If you request a replacement and the product is no longer available, we may ask you whether you wish to receive another product we have available. If so your order will be amended. Otherwise, we will treat the order as cancelled for full refund.
6. FREE GIFT WITH PURCHASE[6.1] Promotional free gifts are only available during specific promotional periods, whilst stock lasts and are not available in conjunction with any other promotional offer.
[6.2] You will be prompted when viewing your basket before checkout of any free gifts you may be eligible for. Gifts will automatically be added to your basket during checkout. Your free gift will be included on your order confirmation with £0.00 value.
7. OFFERS AND DISCOUNTS[7.1] Promotional offers and discounts are only available during specific promotional periods, whilst stock lasts and are not available in conjunction with any other promotional offer or free gift.
[7.2] Offers and discounts apply to BeautyBLVD products only and exclude gift cards.
[7.3] Discounts will automatically be applied to your basket and during checkout.
[8.1] All measurements are approximate.
[8.2] The reproduction of colours is as accurate as the photographic and production process will reasonably allow.
[8.3] All risk in the products we supply to you, in particular the risk of any loss or damage, shall pass to you on delivery of the products to the address you specify in your order. Ownership of the products shall not pass to you until we have received payment in full in respect of such products.
[8.4] We shall not be liable for any indirect losses you may suffer, including any loss of profit, income or anticipated savings as a result of our failure to comply with these terms or our negligence. Save that our liability in respect of any death or personal injury caused by our negligence shall not in any way be restricted.
[8.5] These terms, constitute the entire terms on which we will provide products to you and cancel and supersedes all prior arrangements and representations, whether verbal or written.
[8.6] We may amend these terms from time-to-time at our discretion without notice to you. Any amends will be posted on this website and will supersede any terms and conditions previously published by us.
[8.7] No delay or failure by ourselves in exercising or enforcing any of our rights or remedies under these terms shall operate as a waiver of those rights.
[8.8] If any one or more of the provisions of these terms should be held by any court to be unenforceable, such provision shall be validly restated to as nearly as possible approximate the intent of the clause and, if such clause cannot be restated for any reason, shall be severable from these terms and deleted.
[8.9] You may not assign or sub-contract any of your rights or obligations under these terms to any person without our prior written consent. No third party shall be entitled to enforce any of these terms whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
[8.10] All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website shall be in English and construed and governed according to English law and the English courts shall have exclusive jurisdiction in all such matters.
